2858. If a person makes an agreement with a company that he will pay a certain amount of non – refundable money every year, and in return he makes a condition that if in case his factory or car or house or even himself sustains any loss or damage, the insurance company will compensate the loss, or will mend the damages or will pay for the cure of diseases; there is no harm in acting upon this agreement with the consent of both parties. And in the case where the person is not content or is forced, the receiver of the money will be liable. Indeed, if this condition is made within the contract of compromise, the correctness of such compromise with this condition is most likely valid and should be acted accordingly.
