Purchase and Sale of Fruits

 

2107. It is in order to sell the fruits before plucking them, when the flowers have fallen, and when the seeds have been formed. Similarly, there is no objection in selling the bunch of grapes before plucking.

2108. It is also permissible to sell the fruits growing on the tree, which have not yet developed the seed, and whose flowers have yet not fallen. However, it must be sold along with something, which grows from the earth like vegetables. Similarly, as per obligatory precautions, same rule is applied to the fruits, which is more than a year old. If the seller puts a condition upon the buyer that he should pick the fruits before the seeds have formed, the transaction is valid without taking more of it.

2109. There is no harm in selling the dates, which have become yellow or red while they are still on the trees but it should not be exchanged for dates. However, if a person owns a date tree in the house or garden of another person, and if its quantity is estimated, the owner of the tree can sell them to the owner of the house or the

 

garden, and in exchange, he takes the dates from the tree other than that tree, if the transaction where the quantity of the dates is neither more nor less than what was estimated, there is no objection in it.

2110. There is no harm in selling cucumber, brinjal (aubergine), vegetables, and the likes of these, which are plucked several times during a year, provided that they have grown and are visible and it is agreed as to how many times during the year the buyer would pluck them, there is no objection in it.

2111. If after the ear of wheat or barley have developed seed, is sold in exchange of something other than wheat or barley, there is no objection in it.
