People on Whom Fasting is Not Obligatory

 

1734. Fasting is not obligatory on a person who cannot fast because of his old age, or for whom fasting causes extreme hardship. However, in latter case, he should give one Mudd food to a poor person for every fast and even in the first case, as per obligatory precaution, he should give one Mudd food as well.

1735. A person who did not fast during the month of Ramadhan owing to old age, if he becomes capable of fasting after the month of Ramadhan, as per recommended precaution, he should perform its Qadha.

1736. Fasting is not obligatory on a person who suffers from an illness which causes excessive thirst, making it unbearable, or full of hardship. However, in the latter case, as well as in the first case, as per the obligatory precaution, he should give one Mudd of wheat or barley or the likes of them to poor, for every fast. Moreover, as per recommended precaution, such a person shall not drink water more than the quantity, which is essential. If he recovers later, enabling him to fast, he should perform its Qadha.

 

1737. It is not obligatory for a woman who is about to give birth to a child in the near future for whom fasting is either harmful for the child she carries or it is harmful for herself. Moreover, in the first case, as per the obligatory precaution, for every fast she should give a Mudd of food to poor. However, if the fasting is harmful for her only, it is not necessary to follow the precaution. Though it is better and she should perform Qadha for the remaining fast.

1738. Fasting is not obligatory for a woman who is suckling a child and the quantity of her milk is less, whether she is the mother or a nurse or a woman who suckles her milk free, if fasting is harmful for the child or to herself. In the first case, she should give one Mudd of food per day to poor and in both the cases, she should later perform Qadha for the remaining fast. However, if such a woman is found who suckles a child without a remuneration or a woman who takes remuneration from the father or the mother or someone else, as per obligatory precaution, she should give away the child and fast.
